Waitaki Event Centre General Terms of Entry and Use

These Terms of Use (Terms) apply to all persons who enter and use (users, you) the Waitaki Event Centre including all sports fields (Facility), which is owned and managed by Waitaki District Council (Council). By entering and using the Facility you agree to comply with these Terms. To the extent that the terms of any user hire agreement, user licence or user booking for use of the Facility are inconsistent with these Terms, the terms of the specific user arrangement will prevail over these Terms.

1 Entry

  1. 1.1All users must pay the relevant fee (if any) to enter the Facility.
  2. 1.2For safety reasons, all bags and personal items may be searched upon entry at the discretion of Council staff. Refusal to comply may result in denial of entry.

2 General Standards of Behaviour

  1. 2.1

    All users of the Facility must:

    1. (a)behave in a safe, orderly and respectful manner at all times;
    2. (b)treat Council staff, contractors, other users, and members of the public with courtesy and respect;
    3. (c)comply with all applicable laws, regulations, bylaws, and relevant standards;
    4. (d)comply with all reasonable directions given by the Council or authorised Council staff; and
    5. (e)avoid conduct that may cause nuisance, disturbance, intimidation or offence to others.
  2. 2.2

    Users must not:

    1. (a)misuse the Facility or any part of it;
    2. (b)interfere with the operation, safety systems or utilities of the Facility; or
    3. (c)obstruct accessways, exits or emergency equipment.

3 Care of Property and Damage

  1. 3.1All users must take all reasonable care to prevent damage to the Facility, equipment, furnishings, grounds, fixtures, signage or surrounding areas.
  2. 3.2No alterations, additions, installations, fixtures, markings, or modifications of any kind may be made to the Facility without the Council's prior written approval.

4 Prohibited Activities and Items

  1. 4.1

    The following activities and items are strictly prohibited at the Facility unless expressly approved in writing by the Council:

    1. (a)firearms, weapons, ammunition, or any object that may be used as a weapon;
    2. (b)flammable, hazardous, or dangerous substances, including fuels, chemicals, gases, liquids, or materials that pose a risk to persons or property;
    3. (c)plant, machinery, vehicles, or other equipment that, by reason of its weight, size, configuration, or operation, may cause damage or injury;
    4. (d)gambling activities, including betting, raffles, lotteries, or games of chance conducted for money or prizes;
    5. (e)smoking, vaping, or the use of tobacco or nicotine products within the Facility or in any smoke-free areas;
    6. (f)alcohol or illegal substances, except where expressly authorised and permitted by law;
    7. (g)any animal, with the exception of any Disability Assist Dog, as defined in section 2 of the Dog Control Act 1996, accompanying a person with a disability; and
    8. (h)any activity that creates an unreasonable risk to health, safety, or property.

5 Noise

  1. 5.1Noise levels must be kept at reasonable levels and must not exceed any applicable noise limits set by law or the Council.
  2. 5.2Users must ensure that noise generated by activities, including voices, whistles, music, announcements and crowd noise does not unreasonably interfere with other users of the Facility.
  3. 5.3Sound systems, amplified music or other amplified equipment may only be used with the prior approval of the Council and must be operated responsibly, at appropriate volume levels, and in accordance with any conditions imposed by the Council.

6 Children

  1. 6.1Children under the age of 12 must be accompanied and supervised at all times by a parent or legal guardian aged 16 years or over while using the Facility.
  2. 6.2

    This requirement does not apply to children participating in organised programmes, events, trainings, or activities that are:

    1. (a)expressly approved by the Council; and
    2. (b)supervised by suitably qualified or authorised instructors, coaches, teachers, or event organisers.
  3. 6.3Parents and guardians remain responsible for the behaviour and wellbeing of children attending the Facility as spectators or outside organised and supervised activities.

7 Photography

  1. 7.1Photography, filming and recording may take place at the Facility for personal, media, promotional or event purposes. By entering the Facility, you acknowledge that you may be incidentally included in lawful photographs or recordings taken in public areas.
  2. 7.2The Council, its staff and contractors may take photographs or recordings of the Facility and its activities for operational, communication or promotional purposes. Where an individual is clearly identifiable and is the primary subject of an image or recording intended for promotional or marketing use, the Council will obtain the individual's consent prior to use.
  3. 7.3

    Users may take photos and recordings at the Facility, provided that:

    1. (a)users must not take photographs or recordings in areas where there is a reasonable expectation of privacy, including changing rooms, toilets, and showers;
    2. (b)where another person is the main subject, you must obtain their permission before taking any photos or recordings and before publishing or posting the image or recording online or elsewhere; and
    3. (c)if the photos or recordings are to be used for commercial purposes, the photographer or organiser must obtain appropriate prior written consent from the Council.
  4. 7.4Council staff may ask to inspect photographic devices if they reasonably believe these Terms have been breached and may require any non-compliant images or recordings to be deleted.

8 Health and Safety

  1. 8.1Users must comply with all applicable health and safety laws, regulations and Council requirements that apply to the Facility and to the activities being undertaken.
  2. 8.2Users must take reasonable care to ensure their actions do not endanger themselves or others and must behave in a manner that supports a safe environment at all times.
  3. 8.3In an emergency, all emergency procedures, evacuation instructions, signage, and directions given by authorised Council staff must be followed immediately.
  4. 8.4Any unsafe condition, hazard, incident, injury, or near-miss occurring at the Facility must be reported by the User to the Council as soon as practicable.

9 Cleanliness and Waste

  1. 9.1Users must not leave waste, food, packaging, or other materials in seating areas, changing rooms, common areas, or outdoor spaces surrounding the Facility.
  2. 9.2All rubbish, litter, and waste generated by activities within the Facility must be placed in designated bins or otherwise removed from the Facility at the conclusion of use.

10 Lost Property

  1. 10.1The Council is not responsible for the loss, theft, or damage of any personal property brought into the Facility by users. All personal property is brought into and used within the Facility at the user's risk.

11 Liability

  1. 11.1Users enter and use the Facility at their own risk.
  2. 11.2To the fullest extent permitted by law, the Council is not liable for any for any loss, damage, cost or expense (including any indirect, consequential or incidental loss) suffered or incurred by a user in connection with the user's entry to, presence at, or use of the Facility, whether arising in contract, tort (including negligence), equity, breach of statutory duty, or otherwise.

12 Breach of Terms

  1. 12.1

    If you do not comply with any of these Terms, the Council may take any or all of the following actions:

    1. (a)refuse to allow you to enter the Facility;
    2. (b)require you to immediately leave the Facility without any refund; and/or
    3. (c)refuse to allow you future entry to the Facility.
  2. 12.2Any breach of these Terms can be reported to the Council at service@waitaki.govt.nz

13 Amendments

  1. 13.1The Council may amend these Terms at any time without prior notice. Updates will be available on the Facility's website. Any amendments will take effect from the date they are published, as shown in the "Last Updated" section of these Terms, which records the date of the most recent version. By entering or using the Facility after any amendment, users are deemed to have accepted the current version of these Terms.
